One of the most common questions from prospective clients is whether hiring a PI is confidential. The short answer is yes, with important nuances. Understanding what protections apply, and how to maximize your privacy, is essential before you begin.
Licensed private investigators in Texas are bound by professional confidentiality obligations under the Texas Occupations Code and their licensing requirements. Watson PI treats all client information, including the fact that you have retained us, as strictly confidential. We do not discuss client matters with third parties without your explicit consent.
Texas does not recognize a statutory PI-client privilege equivalent to the attorney-client privilege. This means that in theory, a PI could be compelled to testify about client communications in a legal proceeding. However, when a PI is retained through an attorney, the work product may be protected under the attorney-client privilege.
If your case involves litigation, discuss with your attorney whether retaining Watson PI through their office would provide additional protection for the investigation.
Use a personal email address and phone number, not a work account, for all communications with your PI. Do not discuss the investigation with friends, family members, or coworkers who do not need to know. Do not post about the investigation on social media. Keep all documents related to the investigation in a secure location the subject cannot access.
