Under the Texas Rules of Evidence, evidence is admissible if it is relevant, reliable, and gathered through lawful means. Surveillance video gathered by a licensed PI in a public space is generally admissible as a business record or through the PI's direct testimony. Evidence gathered through illegal means, trespassing, wiretapping, unauthorized account access, is inadmissible and may result in sanctions against the party who obtained it.
Chain of custody documentation establishes that evidence has not been tampered with between the time it was gathered and the time it is presented in court.
